- SIGNING OF THE SALE AGREEMENT
If the buyer decides to buy an apartment, the next step is signing the sales contract. The purchase agreement defines the subject of the purchase, the total agreed purchase price, as well as the method and term of payment thereof. By signing the sales contract, the down payment institution is also contracted in accordance with the law on obligations.
- NOTARY PROCESSING – OF SALES AGREEMENT
After the signing of the purchase agreement between the buyer and the seller, upon fulfillment of certain conditions (technical acceptance performed, usage permit obtained, floor plan completed and the same carried out in the ZK office), the notarized purchase agreement with all elements is signed.
The buyer is presented with a ZK extract with a precisely defined KČ (cadastral parcel floor), the subject of sale, the total agreed purchase price, the method and deadline for payment, the method and deadline for introducing the buyer into possession of the apartment are defined.
The seller - an authorized person or an authorized representative and the buyer - sign the contract at the notary.
The costs of notarial processing of the sales contract are borne by the buyer!
- PAYMENT OF THE PURCHASE PRICE
The buyer is obliged, in accordance with the defined method and term of payment of the price from the sales contract, to pay the same in the defined amount to one of the transaction accounts that the seller has opened with commercial banks and which are specified in the sales contract.
- PURCHASE - PAYMENT BY CREDIT
If the buyer decides and the payment is made through a housing loan or mortgage loan, it is necessary to apply to one of the commercial banks with a notarized contract. If it is a mortgage loan, a statement is necessary - the consent of the seller to pledge the real estate - the apartment that is the subject of the contract.
Upon approval of the loan, the buyer signs the loan agreement with the creditor bank, and after that, the mortgage agreement is signed by the buyer - the loan beneficiary, the bank representative and the seller's attorney.
After the mortgage contract is signed, it is registered in the ZK office, and the creditor bank transfers the amount approved by the loan contract to the seller's transaction account.
The costs of notarial processing of the mortgage contract are borne by the buyer.
- ACCOMMODATION - HANDOVER OF THE APARTMENT
The entry into possession of the real estate - apartment is made after the technical acceptance of the building has been completed (use permit obtained) and after the buyer pays the seller the agreed purchase price in full. By fulfilling these conditions, the buyer acquires the right to enter the property. The seller issues a certificate to the buyer that the agreed price has been paid in full.
The seller and the buyer visit the property together and draw up a record of the handover of the property, on which occasion the buyer receives the keys to the apartment. With the record of handover of the real estate, a copy of the identity card and a copy of the notarized contract, the buyer registers as a user with the competent KJKP and other authorized companies (water, gas, heating, telephony, etc.).
Registration and connection of electricity. of energy is realized in accordance with the regulations of FERK and the regulations on connections of JP Elektroprivreda, which is defined in the sales contract.
- APPLICATION TO THE TAX ADMINISTRATION
All buyers of newly built apartments, in accordance with the current legal regulations, are exempt from paying real estate sales tax because they buy a newly built apartment from a legal entity - the builder. Regardless of the above, the buyer must contact the competent tax administration within the legal deadline and obtain a decision on sales tax exemption. According to the location of the object - real estate in the area of the political municipality in which the object was built, the jurisdiction of the tax administration is also determined.
- REGISTRATION OF OWNERSHIP
Upon payment of the entire amount of the purchase price, the buyer receives a written confirmation from the seller that the purchase price has been paid in full. With the aforementioned confirmation, the buyer receives the original copy of the contract from the notary who notarized the purchase agreement with the clause intabulandi - a tabular statement on the basis of which the buyer can be registered in the land register as the owner of the property without the consent of the seller.
The buyer becomes the owner of the real estate only when it is registered in the land register. In order for the buyer to be registered as the owner, he must first obtain a sales tax exemption decision from the competent tax administration.
Only with the decision obtained, the original of the purchase contract is submitted to the ZK office of the Municipal Court in Sarajevo.
